A federal appeals court has vacated the sentence of a former Philippine National Police officer imprisoned for obtaining secret U.S. documents.
Michael Ray Aquino pleaded guilty in Newark in 2006 to unauthorized possession of classified documents and has been serving a six-year, four-month sentence.
The U.S. District Court ruling published Friday concludes that the sentence was based on a mistaken interpretation of federal guidelines. Aquino will be resentenced at a time to be determined.
Aquino acknowledged accepting the documents from a former Marine who once worked as an aide to vice presidents Al Gore and Dick Cheney before becoming an FBI intelligence analyst at Fort Monmouth. Leandro Aragoncillo is serving a 10-year sentence.
